Judge Refuses To Rule On Albany Power Struggle

ALBANY -- An upstate judge said today that he won't rule on last week's takeover of the State Senate by a coalition of Republicans and dissident Democrats.

State Supreme Court Justice Thomas McNamara tossed the case, saying it's an "intrusion" for the court to get involved in a legislative matter.

He recommended that lawmakers resolve the question of who's in charge of the 62-member chamber on their own.

Republican and Democratic senators so far have failed to work out a power-sharing agreement following the shocking revolt June 8 by a coalition of Republicans and two dissident Democrats that upended Democratic control of the chamber.

Meanwhile, Gov. Paterson's counsel Peter Kiernan put forth another plan called a "stipulated" session.

"The goal is to get an agreement on what we would call a 'stipulated' session, whereby the parties would come into session and pass legislation that has to be passed without prejudice to their respective positions in the courts," he said.

"We're going to find out if that's something that the Republican leadership will agree to. The Democrats have indicated that they might."
